Peterson was convicted of the 2002 murders and was sentenced to death. Last year, the California Supreme Court overturned that sentence, saying that there were errors made in jury selection, The New York Times reported. At the time, jurors who said they would not support a death penalty sentence were improperly dismissed.

Peterson was moved quickly after his attorney filed paperwork saying he was having trouble communicating with Peterson at the San Quentin Prison, the Sacramento Bee reported.

In a new hearing scheduled for February, a judge is expected to resentence Peterson to life in prison without the possibility of parole, KTVU reported.
